ORDER

1. The complainant has filed the present complaint against the OPs under section 35 of Consumer Protection Act, 2019. Arguments on the admissibility of the complaint on the point of territorial jurisdiction heard.  It is submitted by the complainant that he is residing at 1/6739, East Rohtas Nagar, Delhi-110032. The OP Insurance Co. works for gain within the territorial jurisdiction of this Commission.  It is further submitted that cause of action also arose within the jurisdiction of this District Commission.  Hence, the present Commission has the jurisdiction to entertain this complaint.

2. We have perused the record, it is found that the policy in question bears the postal address of  Reliance Centre, South Wing, 4^th Floor, Off. Western Express Highway, Santacruz, East Mumbai, Maharastra-400055. The office of the OP mentioned in the array of parties at point 1 as well as point 2 does not fall within the territorial jurisdiction of this Commission. The branch office mentioned at point 2 in the array of parties does not attribute any cause of action.  Even policy was not issued from this office.  So far as the residence of complainant is concerned, it also does not fall with the territorial jurisdiction of this Commission.  Hence, neither the address of complainant nor the OP even no cause of action  has arosen within the territorial jurisdiction of this District Commission

3. In view of the above discussion, we are of the considered opinion that this District Commission does not have territorial jurisdiction to entertain and adjudicate the present complaint. The complaint is, therefore, directed to be returned to the complainant along with all annexures against receipt. 

Copy of the order may be forwarded to the complainant to the case free of cost as statutorily required. The orders be uploaded on www.confonet.nic.in. File be consigned to Record Room.
