               The Complainant is not present, the Opposite party present through representative.

             The Opposite party has filed copy of the plaint in a suit filed by the present Complainant against the present  Opposite party before the Court of Bombay Civil Court at Dindoshi. According to the Opposite party, relief sought in the present complaint as well as Civil Suit are the same.

            Moreover, the representative of the Opposite party has submitted that the Complainant has not served copy of the complaint and documents to file written version of defence.

          It appears that the Complainant has invoked jurisdiction of the Civil Court to seek the redress. It is possible that the Complainant may not be interested in  prosecution of the present complaint. In view of this, the complaint stands dismissed with no order as to costs. Parties be informed, accordingly.
