Complainant and Op’s are absent . this case is pending for disposal from 24/06/10 we have gone through the w/v filed by Op no-01 . the Op no-01 has stated in para 7,9,10,11 and 12 of the w/v that this case is not maintainable in view of the provision of sec7-B of the  Telegraph Act. 

The complainant has filed this case against the Op’s for rasing wrong bill for Reliance Net  Connection Data Card . This case is cover under the provision of the Telegrape Act where the remedies lies under the section 7-B of the Telegrape Act . 

Considering the pleading of the Op no-01 and the decssion reported in 2009 (4) CPR 119(S.C) and decission of the State Consumer Dispute Redreasal Commission  in FA 460/2004 and served the cases decided on 30/11/2009 , we fund and hold that this case is not Maintainable . Accordingly this case is dismissed with this observation the complainant is at leberty to take action in accordence with provission of section 7-B of the Telegrap Act 1885.
