            The case of the complainant presented on 2/7/14 is as follows.

 

          He had a digital T.V service connection from the opposite parties.  When the set up box became defective the complainant contacted the opposite parties several times to rectify the defects.  But the opposite parties has not properly attended the complainant’s TV and set up box.  The payments were collected from the complainant’s bank account.  The technician from opposite party once attend the set up box and told that the problem would be rectified in short time.  But there after the problem was not rectified.  The act of the opposite parties amounts to deficiency in service on their part.  At present the set up box was with the opposite parties.  Hence this complaint.

          The notices were served with the opposite parties.  They appeared some postings and they had not filed any version.

          The complainant filed proof affidavit and one document which is marked as exhibit A1.

          Heard complainant.  We have gone through the complaint, documents and evidence.  The case of the complainant stands un-challenged by the opposite parties even after accepting the notice from this forum.  So we have no reasons to dis-believe the case of the complainant.  We are of the opinion that the case of the complainant is to be allowed.

          In the result the complaint is allowed as follows:

          We direct the opposite parties to hand over the set up box with perfect working condition and pay Rs.2500/- as compensation for deficiency in services and pay Rs.2000/- as costs of these proceedings to the complainant.

          The order shall be complied with within a period of one month from the date of receipt of a copy of this order.  The order not complied within one month the amount will carry interest @ 10% per annum from the date of order till payment.
