Order no. 02      dt. 13/02/13

Complainant in person is present. Today is fixed for admission hearing. Heard  the complainant in full and upon perusal of the record we are of the view that the instant complaint  case cannot be entertained by this Forum, in view of the decession passed by the Apex Court of India on 01/09/2009 Civil Appeal no. 7687 of 2004 published in AIR 2010, SC 90 wherein Hon’ble Apex Court was passed to hold that such type of complaint / Dispute shall be determined by the Arbitrator.
In view of the above findings we are of the view that the this case is not entertainable by this Forum and instant complaint stands rejected.
Complainant is at liberty to agitate the issue on the salf same cause of action before the appropriate Forum.
A plain copy of the order be supplied to the complainant free of costs.
