ORDER

Per – Hon’ble Mr. Justice S. B. Mhase, President

Today when the matter is called out, the Appellant is absent.  He was absent even on previous date i.e. 15/6/2012.  On the previous date we had directed to issue notice before admission returnable on 25/7/2012 to the Respondents through State Commission by RPAD at the cost of the Appellant and the Appellant was directed to submit requisite compilations of appeal memo so as to enable the office to send the notices to the Respondents.  Further, in the previous order we had also clarified that if necessary compilations are not submitted to the office within a period of eight days then in that case the appeal shall stand dismissed for non-compliance of the order passed by the Commission.  However, today the endorsement made by the registry reveals that as the Appellant did not come with requisite papers for service of notice to the Respondents in compliance with the earlier order dated 15/6/2012, notice could not be issued to the Respondents.  Thus, there is a default on the part of the Appellant to comply with the order passed by the Commission and, therefore, in view of the earlier order dated 15/6/2012 the appeal stands dismissed for non-compliance.
