     The complaint filed by the complainant involves  a matter which is covered under section 7(B) of the Indian Telegraph Act.  The Hon’ble Supreme Court has ordered that matter which are covered under section 7(B) of the Indian Telegraph Act cannot be taken up by the Consumer Fora  (CGM, MTNL v. M. Krishnan). The complaint is accordingly not maintainable in this forum.

  Even otherwise, this complaint is barred by limitation as it has been filed before the limitation period of 2 years.  The cause of action had accrued to the complainant on 8-1-2013 and the complaint was filed in this forum on  6-1-2015.

 We, therefore, dismiss the complaint.

 

 

Copy of the order be made available to the parties as per rule. 

  File be consigned to record room.
