Brief fact of the Complainant case u/s 12 of the C.P. Act, is that the complainant Sadhan Kundu Prop. Of Kundu Enterprise is running a small mobile set shop for his livelihood. On 26.06.2014, two persons came to his shop and purchased one Sony ZL mobile with price of Rs. 26,990/- through a master card in the name of Somesh Majumder. But one of them named Akash Halder put his signature on the merchant copy. The Complainant observed that on the same date the amount was credited in his A/C and settlement report also shows the said transaction. But surprisingly the OP Bank send a letter on 22.07.2014 to the complainant that the said amount of Rs. 26,990/- was debited from the A/C of the complainant. According to complainant the act of OP Bank is very much illegal and arbitrary, which helps to do illegal purchasing without money in the connivance with Master Card holder and Master Card bearer. Then the Ld. Advocate, Sri. Subhash Saha on behalf of the complainant served a notice to the OP to credit the disputed amount of Rs. 26,990/-, but the OP/Bank did not pay any heed to the matter. This act of the Bank is an example of deficiency in service, so the complainant filed this case to this Forum for redress.
The complainant submitted all necessary documents like selling transaction details, merchant copy slip, settlement report, Ld. Advocate’s letter, Bank’s letter etc., in support of his case.
It is very much appreciable that at the time of admission hearing the complainant filed a petition praying for withdrawal of the case, as because, the Op/Bank credited the disputed amount of Rs. 26,990/- in the A/c of the complainant. So, the petition is accepted and thus the case shall be disposed off.

Ordered
that the consumer Complaint No. 176/2014 be and the same is disposed of being not admitted as the complaint has been withdrawn by the complainant due to amicable settlement.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under registered past with A/D to the concerned parties as per rules, for information and necessary action.
