The complaint filed against the Opposite Party for the non issuance of the original R.C, duplicate Permit and Insurance Certificate of the vehicle No.KL2J 9548.

The complainant is the R.C owner of the Autorikshaw No.KL 2J 9548. The permit of the autorikshaw was lost from the possession of the Complainant. To avail a duplicate permit application was given by the Complainant to the Opposite Party on 20.11.2006 along with original R.C, Insurance Certificate and C.F.card. The Complainant was intimated to collect the documents from the Opposite Party's office on 11.01.2007. But till the date of this petition the Complainant was not issued the documents that are highly in need for the Complainant. The Complainant is not in a position to ply the vehicle on the road in the absence of the permit R.C and other original records. On 11.01.2007 the Opposite Party informed the Complainant as admitted that the original records and duplicate permit were to be received from the Opposite Party's office on11.01.2007. The non issuance of the documents by the Opposite Party is the reason for the complaint and the cause of action invoked for the purpose of this complaint begins from 11.01.2007. The subsequent events and representation cannot be considered as a reason for extending period of limitation is it is laid down by the Hon'ble National Commission in T. Seshaiah & Another V/S Standard Chartered Bank & others (2009 CPR Page-257). The complaint is filed not within the limit of time hence it is dismissed in limine.
