The C.C Case No. 67/2019 have been pending since long which is against the principle of C.P. Act,2019. Hence it is taken up on priority basis. Grievances of the Petitioner against the R.T.O. Chandikhole committed mistake while registering the certificate of Registration. Name of the Complainant entered in R.C.Book as Abdul Khan instead of Abdul Imran Khan.
The Complainant appeared in person and submitted that, during submission of documents the Complainant submitted Form No.23 under Rule-48 of M.V.I. Act, where it was found in the column name of registered owner Abdul Imran Khan so also father’s name Abdul Dayan Khan where under deposited Rs. 1555/-, but the Registering Authority (Op) omitted Imran and also omitted Dayan in his father’s name. As prayed by the Complainant such incorrect entries are deficiency of service by the Op (R.T.O. Chandikhole). It revealed from the record that, the Op received the notice & the Postal tracking exhibited by the Complainant. Notice was sufficient but the Op did not appear even after receiving the notice and for which set-exparte.
O R D E R
Taking into the facts & circumstances & prayer made by the Complainant, it is our considered view that, the Op(RTO, Chandikhole) shall correct the owner’s name & his father’s name correctly as Abdul Imran Khan, S/o- Abdul Dayan Khan in R.C.Book of vehicle No. OR-04-D-4688 within a period of one month, failing which appropriate action will be taken against the Opp Party as per legal remedies available under the law.
On the above order this C.C.Case is accordingly disposed off, but no order as to cost.
Issue extract of the order to the parties for compliance.
