Sri. Udayakumar has filed this complaint before the Forum on 6.12.2011 alleging deficiency in service on the side of opposite parties. The main prayer of the complainant is for giving a direction to the first opposite party to renew the permit in respect of his vehicle bearing No.KLO 4/V/5639 and for compensation for his monetary loss due to the action of the 2nd and 3rd opposite parties and for an interim order. At the time of filing the complaint, we have heard the matter. Since the complainant has a prima facie case, the Forum issued an interim order vide dt. 6.12.2011 in IA No.245/11 and posted the matter to 19.12.2011 for detailed hearing.
When the case taken up on 19.12.2011, complainant was absent; called – no representation on the side of the complainant. Advocate Sri.P.T. Rasheed appeared for the 2nd and 3rd opposite parties and filed vakalath along with the version of the 2nd and 3rd opposite parties. He has argued the matter in detail and submitted that there is no deficiency in service on the side of the opposite parties 2 and 3. Considering facts and circumstances of this case and the absence of the complainant and his council, we are of the view that the complainant is not interested to proceed this matter. In this context, we are of the further view that the matter need not be proceed further. The interim order already issued on 6.12.2011 is stands vacated.
In the result, complaint dismissed.
