DISTRICT CONSUMER DISPUTES REDRESSAL COMMISSION: NORTH-EAST
The Complainant has filed the present complaint under Section 12 of the Consumer protection Act, 1986.
Case of the Complainant
The case of the Complainant as revealed from the record is that Complainant was a holder of License for driving of motor vehicle for last 15-20 years. The said licence was issued by the Opposite Party i.e. Regional Transport Office, North East Zone, Loni Road, Shahdara, Delhi. The validity of said Licence was till on 28.10.2017. Complainant went to the Opposite Party office for renewal of his licence. Complainant fulfilled all the formalities for renewal of his licence. When Complainant received the licence he found that the date of issuing and the date of expiry of the driving licence was the same i.e. 28.10.2017. Complainant immediately went to Opposite Party office for rectification of this error. It is alleged that Opposite Party told him to apply for a fresh driving licence instead of rectifying its error. Complainant stated that he suffered mental and physical agony due to this.
Complainant has prayed for issuing direction to Opposite Party to correct the date of expiry in the Driving Licence No. DL-0520170337151. He has also claimed Rs. 5,00,000/- as compensation for the mental and physical agony.
Complainant has attached copy of Aadhar Card and copy of Driving Licence.
Case of the Opposite Party
Opposite Party contested the case and filed written statement. In its written statement the contents of the complaint are admitted to be a matter of record. It is also stated that the licence was rightly issue under Section 14 of Motor Vehicle Act, 1988.
Evidence of the Complainant
The Complainant in support of his case filed his affidavit wherein he has supported the assertions made in the complaint. He has relied upon the documents i.e copy of Aadhar Card and copy of Driving Licence.
Evidence of the Opposite Party
In order to prove its case Opposite Party filed affidavit of Shri R. Ramanathan, Motor Licensing Officer, North East Zone, Loni Road, Delhi.
Arguments & Conclusion
We have heard the Learned Counsels for the parties. We have also perused the file and the written arguments filed by the parties.
The case of the Complainant is that he applied for renewal of his driving licence on 28.10.2017 and he was issued driving licence after its renewed on 28.10.2017 and its validity was for one day only i.e. 28.10.2017. The case of the Opposite Party is that u/s 14 of the Motor Vehicle Act, 1988 driving licence has been issued rightly as the Complainant attained the age of 50 years on 28.10.2017.
Admittedly, the driving licence was issued to the Complainant by the Opposite Party and the same was valid only one day i.e. 28.10.2017. The applicant/Complainant should have been issued the driving licence for the period of five as per the provision of Section 14 of the Motor Vehicle Act, 1988. There is no fun for issuing a driving licence to a person only for a one day. Therefore, the complaint is allowed. The Opposite Party is directed to issue driving licence to the Complainant for a period of five years w.e.f. 28.10.2017. In the fact and circumstances of the case the Opposite Party shall pay Rs. 10,000/- (rupees ten thousands only) to the Complainant as compensation on account of mental harassment and litigation expenses. The said amount shall carry an interest @ 6% p.a. from the date of this order till its recovery.
