Today as per the CMS note submitted by the Ld. Counsel for the complainant that C.C. No. 174/2019 has been fixed for admission hearing. However, the same has not appeared in the day’s list. Under such circumstances, the matter is taken on day’s list. The Ld. Counsel for the Complainant submits that he intends to withdraw the Complaint and wants to file a fresh Complaint since there has been exclusion of one necessary Opposite Party.

As the ld. Counsel for the complainant submits that the complainant wants to file a fresh Consumer Complaint due to some mistake regarding inclusion of necessary party, the prayer of the complainant should be considered and allowed.

Hence, it is

that the Consumer Complaint being No. 174/2019 be and the same is dismissed as withdrawn. However, the complainant is at liberty to file the complaint afresh, if there is no bar otherwise.
