Final Order / Judgement

Order no. 8 , dt. 11.1.2024

This case record is taken up for consideration for passing order in the matter of prayer for passing an order of injunction which is filed by applicant who is the complainant of CC-127/2023.

This matter has been contested by the Op by filing written objection against the said injunction petition.

The argument which has been highlighted by ld. advocates of the applicant side and OP of this case has been heard in full.  Considered submission.

Perused the injunction petition which is filed by the applicant (who is the complainant of CC-127/23) and also examine the written objection filed by the OPs of this case (who are also the OPs of above noted CC case).

On close examination of the injunction petition and its connected documents and on parallel reading of the injunction petition and written objection filed by the parties of this case and also after comparing the documents filed by both sides this District Commission finds that there is a prima facie case, there is a balance of convenience and inconvenience in favour of the complainant / applicant of this case and there is urgency of passing such order of injunction and if such order of injunction is not passed, the main purpose of passing such order would be defeated by delay and the complainant side shall suffer irreparable loss and injury.  But fact remains that the order of injunction in the manner maintaining status quo by both parties over the suit property in respect of its nature, character, right, title, interest and possession would be the just and proper order at this stage.

So the parties of this case are directed to maintain the order of injunction in the form of status quo over the suit property in respect of its nature, character, right, title, interest and possession till the disposal of this case.

In the light of the observation made above this MA case is disposed of on contest.
