The case of the complainant in short is that complainant booked a Montero Suv vehicle of Mitsubisi car through its dealer Shah Automobiles through bank loan of Rs.30 lakhs to be granted by HDFC Bank and complainant paid Rs.1 lakh in cash to o.p. nos.2 and 3 and o.p. no.4 granted Rs.65,000/- in this regard.
Matter was contested by o.p. nos.2, 3 and 4 and matter has been heard ex parte against o.p. no.1.
Complainant has stated that the has not been delivered the car by o.p. no.1 for non payment and has prayed for refund of money before this Forum.
We have gone through the entire materials on record and we find that the valuation of the car is Rs.30 lakhs as we find from para 1 of the petition of complaint which is beyond the jurisdiction of this Forum and this Forum is not in a position to entertain this case for want of pecuniary jurisdiction.
Hence, ordered,
That the instant case stands dismissed for want of pecuniary jurisdiction. Complainant is at liberty to file the case before the appropriate Forum on the self same cause of action.
