Complainant and her Ld. Lawyer and also O.P. Shibananda Saha (JDR) and O.P.-4 and O.P.-1 & 2 (JDR) are present. Fact remains that JDR-1 & 2 have already paid Rs.43,520/- on 28/11/2013 and litigation cost of Rs.10,000/- on 31/12/2013 and so DHR's part of decree is satisfied by the Bank.
JDR-4 has complied the order of this Forum by taking all steps about pension matter of Shibananda Saha.
Hence, ordered that the Ex. Case be and the same is disposed of on full satisfaction.

Today record is placed before this Forum as per prayer of Jdr -1 and 2. It is submitted by Jdr-1 and 2 that Jdr-4 Sl. Of Schools Ulberia North Circle P.O Ulberia P.S. Ulderia Dt. Howrah has not been deducting balance umpaid loan amount from thesalary of op-3 Shibananda Saha abd has not been remitting monthly to op-1 and 2s bank and has not noted it in his service book.
But op-4 submitted on 10/01/2014that he has complied the order of the Forum but now it is found that op-4 submitted false declaration as responsible govt. officer. So considering the above fact and to juste by the allegations of op-1 and 2 Bank. Cognizance is taken a fresh and op-4 is directed to appear before this Forum along with service book of Shibananda Saha positively and to submit a statement abount monthly deduction against oayment if outstanding loan amount to the bank from salary of Shibananda Saha.
Op-4 is directed to appear personally along with said service book of Shibananda Saha and statement of deduction and remittance bank op-1and 2 positively on 28/01/2015 failing which warrant shall be issued against Jdr-4 Sl. Of School.

St. Dilip Maity of ULBERIA NORTH CIRCLE has produced the service Book of Shibananda Saha where from it is found that so for Rs. 65000/- has been deducted and it is now bying District Primary Schhol Council 18, Nityindhan Mukherjee Road, Howrah-1 but same has not been deposited by the said authority to the Central Bank of India Kulgachia Branch against Loan Account Number-2128903935 stand in the name of Shibananda Saha.
So arbitrary act of DPSC Howrah is proved and so Secretary and Chairman DPSE are directed to deposit entire deducted amount to the above account at once and to the above account at once and also directed to keep watch about the pension matter of Shibananda Saha as per order of this Forum .
It is proved from the materials papers that Account department of DPSE are very much reluctant in depositing that amount regularly which tantamount to deficient and negligent manner of service of it is Continued every after passing of this order the concerned officer and staff shall be penalized.
DPSE Howrah to comply order strictly. St. D. Maity to submit this copy of order to DPSE Howrah and report this Forum.
