| Final Order / Judgement | Order No. 04 Date - 31.03.2021 Record is put up for order. The matter was heard on 26.03.2021. Having heard the Ld. Advocate for the complainant and on perusal of the contents of the petition of complaint coupled with documents annexed thereto, it appears to us that the complainant purchased a Swiss made XYLYS Brand Wrist Watch from OP-2 on 15.12.2020 subject to payment of EMIs of Rs. 4,349.23 per month. The showroom from where the complainant purchased the wrist watch is situated at Shyambazar, Kolkata -700004 within the jurisdiction of Shyampukur PS. OP-1 is the Regional Office of World of Titan which is situated within jurisdiction of Park Street PS. OP-1 is not a Branch Office and/or showroom of World of Titan. In our opinion, the cause of action of the present consumer complaint arose at Shyambazar within the jurisdiction of Shyampukur PS which is outside the jurisdiction of this commission. Therefore, we are not inclined to admit the complaint for want of territorial jurisdiction. Hence, Ordered That the consumer complaint is not admitted for want of territorial jurisdiction. Complainant may file the complaint before the competent commission, having its jurisdiction, if so desired. In view of non-admission of consumer complaint the Miscellaneous Applications dated 03.03.2021 & 26.03.2021are not tenable and rejected. Thus, MA being Nos. 246/2021 & 300/2021are disposed of. | |
