Sh.Kshitij Sharma, Manager of the opposite party got recorded statement that he has been authorized by the opposite party vide resolution ex.OP1 and vide resolution dated 1.4.2016, parties have compromised the matter. As per the compromise, opposite party has to refund Rs.11,70,522/- I.e.principal amount to the complainant within 3 months from today and in case of non payment in the said period of 3 months, complainant shall be at liberty to initiate proceedings u/s 27 of the Consumer Protection Act. In view of the above statement, Sh.Deepinder Singh,Adv.counsel for the complainant got recorded his statement withdrawing the present complaint reserving his right to initiate proceedings u/s 27 of the Consumer Protection Act against the opposite party in case of breach of the statement. Resultantly, present complaint is dismissed as withdrawn. File is ordered to be consigned to the record room.
