Final Order / Judgement

Present : Sh.Updip Singh, Adv.counsel for the complainant

                              This order of  this Commission will dispose of an application for withdrawal of the present complaint as the matter stands compromised between the parties. The complainant has prayed   to this Commission that at the time of filing of the complaint, the complainant had deposited Rs. 1,00,000/- with this Commission as per directions  of this Commission vide order dated  24.12.2021 to stay the recovery of the impugned demand. It is prayed that since the matter has been compromised between the parties, said amount  lying with this Commission be also released.

                            Heard. Report from the concerned bill clerk  also sought regarding the deposit of the amount and it is reported by the concerned clerk of this Commission that as per record cheque bearing No.005775 dated 5.1.2022 amounting to Rs. 1,00,000/- was deposited in this Commission which is lying in the account of this Commission. Since the matter has been compromised between the parties and now the complainant wants to withdraw the present complaint in view of the compromise between the parties and there is no need to  put on hold the amount lying with this Commission which was a condition imposed by this Commission at the time of allowing ad-interim relief to the complainant. Hence, it is ordered that the amount of Rs. 1,00,000/- with interest, if any accrued thereon, be released to the complainant against proper receipt and identification. Concerned clerk is directed to take up the matter with the bank  for the calculation of the interest, if so required. Hence, present complaint stands disposed of  as dismissed as withdrawn. File be consigned to the record room.
