ORDER

 

                   In brief, the case of the complainant is that he had purchased a pair of Reebok shoes from Op No.1 on 24.08.2018 for a sum of Rs.1610/- after availing seasonal discount as the actual price of the shoes was Rs.2299/-. The shoes were having three months warranty but the same got cracked within 10 days of its purchase. The complainant approached the Op No.1, which kept the shoes with it initially, but failed to redress the grievance of the complainant. The act and conduct of the Ops clearly amounts to deficiency in service on their part.

2.                None has appeared on behalf of OP No.1, therefore, it was proceeded against exparte vide order dated 20.05.2019. However, the complainant has given up the Op No2 by making his separate statement on 20.05.2019.

3.                The complainant in evidence has produced the invoice Ex.C1.

4.                We have heard the complainant and have perused the case file carefully.

5.                The complainant has specifically pleaded that he has purchased pair of Reebok shoes from Op No.1 for a sum of Rs.1610/- vide Ex.C1 after availing seasonal discount but the same started cracking within a short span of its purchase and the Ops have failed to redress his grievance despite repeated requests and visits.  Since opposite party No.1 did not appear to rebut the plea and evidence of complainant, as such, evidence led by complainant goes unchallenged and unrebutted.

6.                In view of above discussion, we allow this complaint and direct the opposite parties to replace the shoes of the complainant with same make and model, without any costs, or in the alternate to make refund of the cost of the shoes, within 15 days from the date of receipt of shoes from the complainant. We further direct the opposite parties to further pay a sum of Rs.500/- as composite compensation on account of mental agony, harassment and litigation expenses. A copy of this order be supplied to the parties free of costs.   File be consigned to record room.
