This case having been heard on 03.08.2017, the Forum on 31.08.2017 delivered the following:

ORDER

SMT. LIJU B. NAIR: MEMBER

Complainant filed this complaint alleging that he was insulted through phone by the receptionist who worked with the opposite party while he attempted to book refill cylinder.  He alleges that she mentally harassed him and for that he approached this Forum to take appropriate action. 

Opposite party entered appearance and filed an I.A to hear the question of maintainability as the preliminary issue, since no service deficiency or unfair trade practice is alleged in the complaint.  For mental torturing this is not the Forum for getting compensation. 

Heard both sides on this question.  The documents produced by the complainant are the receipt of complaint he had given to Human Rights Commission and the front page of the gas consumer book.   Complainant failed to prove any service deficiency or unfair trade practice as pointed out by the opposite party at this stage.  He claims compensation for mental harassment.  We find that this Forum lacks jurisdiction to order on such claims.  So this complaint is not maintainable, which is only to be dismissed. 

In the result, I.A is allowed.  Complaint found not maintainable.  So C.C 31/2016 is dismissed on that ground. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
