The Complainant has filed the present complaint under Section 35 of the Consumer protection Act, 2019.
The case of the Complainant is that she ordered a Real Me 7i fusion Blue 4GB RAM and 128GB mobile phone from Flipkart account and the same was delivered to Complainant on 19.10.20. The Complainant stated that she paid Rs. 13,000/- to delivery person by cash. The Complainant stated that the phone in question going to restart again and again so Complainant lodged a replacement request with Opposite Party. After 3-4 days the technician from Opposite Party visited Complainant and found problem in phone and assured Complainant that he will registered for replacement of mobile in question. The Complainant stated that thereafter Opposite Party blocked the account of Complainant. The Complainant stated that from the date of purchase the said mobile shows various problems neither Opposite Party replace the said mobile nor had they refunded the amount of Complainant. The Complainant stated that she had lodged various complaints to Opposite Party but Opposite Party did not paid any heed to the request of Complainant. On 06.10.21 Complainant visited service centre of realme and officials of Opposite Party stated that the said mobile cannot be repaired under warranty as there is dent on SIM tray. The Complainant visited service centre of realme but customer care of Opposite Party did not helped Complainant and lodged complaint and told Complainant that senior will call him till 14.10.21 but no call was received by Complainant. The Complainant also sent a legal notice to Opposite Party dated 14.03.23 but Opposite Party ignored the same. The Complainant has prayed either to refund the amount of Rs. 13,000/- or replacement of the said mobile phone. She further prayed for Rs. 1,00,000/- for mental harassment and Rs. 1,00,000/- on account of deficiency in service.
In the present case, the Complainant did not produce any invoice or bill of the mobile in question purchased from Opposite Party and Complainant also failed to place on record any document of payment made to the Opposite Party. In our considered view, her case is not covered u/s 7(i) of the Consumer Protection Act, 2019.
In view of the above, we did not see any ground to admit the complaint. The complaint is dismissed.
