Consumer Complaint under Section 35 of Consumer Protection Act, 2019

Present:        Shri Rohit Rana, Advocate, Counsel for the Complainant.

                     Shri Yoginder Nagpal, Advocate, Counsel for OPs No.1 and 2.

 

         

                     Today the case is fixed for appearance of OPs. At this stage, the Ld. Counsel for the Complainant by making a separate statement tendered copy of offer of settlement made by the OPs, as Mark A, which was duly accepted by the Complainant, vide which the matter has been settled between the parties and the payment has been duly made by the Complainant as per Mark B, and, therefore, he seeks permission to withdraw the present Complaint on behalf of the Complainant.

           On the other hand, Ld. Counsel for the OPs No. 1 and 2 filed power of attorney and by making a separate statement stated that he agrees with the statement made by the Complainant that the matter in question has been settled between the parties as per the copy of offer of settlement made by the OPs No.1 and 2, and which was duly accepted by the Complainant i.e Mark A and the payment has been duly received by the OPs No. 1 and 2, as per Mark B, and, therefore, he requested that the present complaint may kindly be dismissed.

          Heard. Since, the dispute in question involved in the present complaint has been settled between the parties as per the statement made by both the Ld. Counsels for the Complainant as well as OPs No.1 and 2, the present complaint is hereby dismissed as withdrawn. However, both the parties shall be bound by their statement made before this Commission. 

A copy of this order be sent to the parties, free of costs and file be consigned to record room after due compliance.
