Case of the complainant in short is as follows:
Complainant approached the opposite party for doing certain aluminum fabrication work to his newly constructed house and entrusted `5000/- as advance on 21-04-2011. But opposite party did not turn up to do the works as against his promise to do the work within 10 days. Hence the complaint.
2. Though notice is sent to opposite party by registered post, he declined to accept the notice and hence it is returned unserved with the endorsement ‘refused’. Therefore opposite party had to be set exparte.
3. Complainant filed affidavit in lieu of examination-in-chief and Exts A1 to A3 marked. Counsel for the complainant heard.
4. In the affidavit also the complainant stated that the complainant did not turn up- to do the aluminum fabrication work though he received `5000/- as advance.
5. There is no explanation forthcoming from the opposite party for not doing the aluminum fabrication work inspite of receipt of `5000/- as advance.
The complaint is therefore allowed opposite party is directed to refund `5000/- to the complainant with interest @ 10% from the date of complaint till payment together with a cost of `2000/-. Time for compliance of this order is limited to 2 months from the date of receipt of copy of this order.
