O R D E R

  1. This Appeal filed by OPs under Section 41 of Consumer Protection Act, 2019, aggrieved by an order dated 04.11.2022, passed in CC/159/2022 by District Consumer Disputes Redressal Commission, Bengaluru Urban District (herein after referred as District Commission and the parties arrayed as in the consumer complaint)

 

  1. Commission examined grounds of appeal and impugned order.  Accordingly found satisfied to dispense with issuance of notice to be served on respondent.

It is the case of the complainant/respondent that appellants/OPs without giving prior notice or information regarding collection of additional cost towards carry bags had collected Rs.24.90/- towards carry bag after purchase of items from OPs store, amounts to unfair trade practice.  Hence professed the Consumer Complaint before the Commission below. The Commission below after holding enquiry directed OPs to refund the amount of Rs.24.90/- i.e., the cost of the carry bag collected by OPs. Further directed OPs to pay Rs.5,000/- towards compensation and Rs.2,000/- towards litigation expenses, which does not call for any interference as the Commission below rightly held – “As a matter of consumer rights the consumer has the right to know that there will be a additional cost for carry bags before makes his selection of goods for purchase from the retail outlet”.  Thus in such view of the matter, Commission proceed to confirm the impugned order and in the result dismiss the appeal with no order as to cost.

 

  1. The Amount in deposit is directed to be transfer to the Forum below for needful.

 

  1. Send a copy of this Order to the District Commission and parties to the appeal.
