ORDER
SRI. P. V. JAYARAJAN: PRESIDENT
This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration. After hearing the matter this Commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint, notice was issued to the opposite party. The said notice was served on the opposite party on 06.05.2024. The opposite party entered appearance and filed written version denying the allegations raised by the complainant. When the case came up for consideration on 25.06.2024, both parties represented that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today, both parties submitted that the matter is settled. A compromise memo signed by both parties is also filed before this Commission. As per the compromise, the opposite party agreed to hand over four gold coins weighing 2 gms. each to the complainant on the date of settlement. The complainant made an endorsement in the above referred compromise memo to the effect that he has received four gold coins of 2 gms. each from the opposite party being the full and final settlement of the dispute. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.
In the result, the complaint is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
