The appellant is the opposite parties/Water Authority in CC.77/10 in the file of CDRF, Palakkad.  The complaint stands allowed.  The opposite party/appellant was exparte before the Forum.  The appellant has contended that it was on account of the lapse on the part of the counsel for the opposite parties that the matter could not be contested.  The complainant is a commercial establishment.  In the circumstances the order of the Forum is set aside on condition that the opposite party pay a sum of Rs.5000/- or on deposit of the same before the Forum which can be withdrawn by the complainant.  On payment of cost the Forum will permit the opposite party to file version and contest the matter.  The Forum will issue notice to the complainant.  The matter stands posted before the forum on 27/12/2010.

The office will forward copy of this order to the Forum.
