Complainant represented.

It has been alleged in the complainant petition that the OP’s raided at the house of the complainant and on the plea of replacement of old meter by digital meter they removed and carried away the electric meter but here in this case the officer of the electricity department have been made OP’s in there individual capacity through his name.

Once they Act was done official capacity they cannot be alleged in their individual an personal capacity by name, hence the very complaint being defective is dismissed however liberty given to the complainant for filing fresh complaint agaisnt the OP’s in there official capacity if the cause of action for the same stands against them but subject to period of limitation given sectin 68 Consumer Protection Act.
