ORDER:                    

 

                Today the complaint is fixed for consideration on the point of admissibility. Neither arguments has been advanced nor none has put in appearance on behalf of complainant.

2.                    The complainant has filed the present complaint u/s 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as ‘OPs’) on the averments that the OPs discovered a world of luxury, exclusive privileges and exceptional perfectly tailored vacation to all types of travelers-couples, families and groups. In this regard, a camp was organized at Deventure Hotel, Namastey Chowk, Karnal by OPs where the OPs approached the complainant and allured him by offering various vacations packages under Rs.81,000/- for five year plan in which complainant can stay in any hotel which are on the penal of OPs. The complainant had paid Rs.81,000/- via online transfer and OPs issued approval form dated 28.07.2020 which is valid for next five years since July. Thereafter, complainant went on a trip and stayed in a hotel which was on the panel of the OPs but when complainant contacted the OPs and asked them to book hotel in Shimla, then OPs demanded money for booking hotel and when complainant opposed, they flatly refused to book any hotel free of costs and replied the complainant that his package has been expired. Thereafter, complainant visited the office of OPs and sent various e-mails to the OPs which are still un-responded. All these acts done by the OPs are subject to fraud with the complainant. Hence, the present complaint. 

3.             None has put in appearance on behalf of complainant from the last two dates. It seems that the complainant is no more interested in pursuing the present complaint.

4.             As per Section 36 of the Consumer Protection Act, 2019, the admissibility of the complaint is ordinarily be decided within twenty-one days from the date on which the complaint was filed. In the present complaint, the complainant has alleged that he has paid Rs.81,000/- to the OPs had issued approval for next five years but the complainant has not placed on file any such document from which it can be ascertained that the OP had issued five years approval to the complainant on making the payment of Rs.81,000/-. In the complaint, the complainant has not mentioned the dates and month when he approached the OP for booking of hotel in Shimla. On one hand, the complainant has stated that the OPs refused to book the hotel and on other hand, the complainant has mentioned in his complaint that he went on a trip and stayed in a hotel. Furthermore, as per the complainant, he has availed the package in the year 2020 for five years and the same is going to expired. The present complaint is nothing but seems to be an clever tactics to extort money from the OP. 

5.             Thus, in view of the above discussion, the present complaint devoid of merits and deserves to be dismissed and same is hereby dismissed in limine. No order as to costs. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
