Heard.

          Learned counsel for respondent states that there is no objection, if the impugned order passed by the State Commission is set aside and the appeal which was dismissed in default, is restored and the matter is remand back to the State Commission to decide on merits, subject to payment of heavy cost.

          In view of statement given by learned counsel for the respondent, the present revision petition is allowed.  The impugned order passed by the State Commission is set aside, subject to payment of Rs.5,000/- as cost to be paid to the respondent directly by way of demand draft within four weeks.  Accordingly, the matter is remanded back to the State Commission to decide afresh on merits after hearing the parties.

          Parties are directed to appear before the State Commission on 28.10.2014.

          With these observations, the revision petition stands disposed of.
