This day was fixed for S/R & appearance and for presentation of the written version by the OPs in the case.

However, on behalf of the complainant a petition has been brought this day praying for withdrawal of the CC case alleging that the dispute has since been settled amicably.

Heard the Ld. Counsel for the complainant in regard to the said petition. The averments made in the petition appears to have been verified by the complainant himself. Having kept in view the circumstances, we think it proper to allow the prayer made in the petition.

Accordingly it is.

O R D E R E D

That the complaint u/s 12 CP Act, brought by the complainant Sri Pranab Kumar Adhikary on 26.10.2010 be deemed to have been withdrawn without any order as to costs.

Let plain copies of this order be furnished to the parties forthwith free of cost.
