None for the appellant as well as its counsel are present. The respondent Ramdas Shirsat is present in person.

On last date notice was issued to both the parties. In response to the notice respondent Ramdas Shirsat appeared today. However, none appeared for the appellant. On perusal of office copy of the notice it reflects that it was issued on the address of the appellant - Society which is given in the appeal memo. Therefore, it will have to be presumed that the appellant is duly served with notice but nobody turned up.

The record further reflects that the appellant as well as its counsel are absent since 26/02/2010. Therefore, as no alternative accepted to appeal dismissed in default. Accordingly appeal is dismissed in default. No order as to cost.
