                                J u d g e m e n t.

        The  present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non refund   a sum of  Rs.13,599/- towards falsely  deducted from the S.B. account  No. 28211530001776  of the complainant.

On being noticed the O.Ps appeared through their learned counsel before the forum  and took adjournments.  Thereafter  neither entering in to appear before the forum nor filed their  written version inspite of more than  21 adjournments has been given  to them. Complainant consequently filed his memo and prayer to set exparte of the O.Ps.  Observing lapses of around 2 years  for which the objectives  of the legislature of the C.P. Act going to be destroyed to the prejudice of the interest of the complainant.  Hence after hearing  the  counsel for the complainant set the case  exparte against the O.Ps. The action of the O.Ps is against the principles of  natural justice as envisaged  under section  13(2) (b)(ii) of the Act. Hence the O.Ps. set exparte  as the statutory period  for filing of  written version was over to close the case with in the time frame permitted by the C.P. Act.

We therefore constrained to  proceed to dispose of the case, on its merit. 

Heard from the complainant.   We perused the complaint petition and the document filed by the complainant.

                                                Findings.

          Undisputedly the complainant is a account  holder of the bank vide account No.28211530001776  and  had  issued  credit card bearing No. 4577044101067372 in favour of the complainant(copies of the pass book is in the file which is marked as Annexure-I).   Admittedly the O.P No.2  had deducted an amount of Rs. 12,842.55 on Dt.20.1.2016, Rs.171.00 on Dt.1.1.2016, Rs.343. 50  on Dt.1.1.2016, Rs.343.50 on Dt.12.1.2016 from the above account  No. of the complainant  on the plea  payment towards the insurance as reflected in the pass book.

          `During the course of hearing the complainant appeared before the forum and submitted that after filing of the above C.C. case the O.Ps have credited  the  deducted amount in the above account   but has  not  increased  the civil score minimum   750 score  point  in the credit  card which was issued by the O.P No.2.  Due to  non  increase the civil score minimum   750 score  point  in the credit  card  the complainant has been deprived of to get the loan from the other banks  for development of  his livelihood. The complainant prays the forum direct the O.Ps to increase the civil score in his credit card to avoid future loan sanction.

          This forum allow the memo filed by the complainant before the forum.

          To meet the ends of justice  the following order is passed:-

                                                                               

 

 

 

                                                                                ORDER.

                The complaint petition stands  allowed in part on exparte.

                The  O.P  No.2    is  directed to    increase the civil score/rating minimum   750   point  in the credit  card bearing No. 4577044101067372 and account No. 28211530001776   of the complainant  and closed the above accounts  without charging any amount to the complainant    which was issued by  the O.P. No.2 in favour of the complainant.

          The  O.P. No. 1 & 3 are directed to refer the matter to the O.P. No.2 for early compliance  of the above order.

The O.P  No.2 (Bank ) is ordered to comply the above directions within 45 days from the date of receipt of this order.
