JUDGMENT

Sri A.K. Bose,  Member- Appeal taken up for hearing. None responds on behalf of the parties. There is no application either. Since the appeal is pending for the last 11 years for disposal, therefore, in view of the provisions contained under Rule 8(6) of the U.P. Consumer Protection Rules, 1987 read with Section 30(2) of the Act, 68 of 1986, we preferred to go through the records.

From perusal of the judgment and order dated 19.2.2003 passed in complaint case no.114 of 2000 by the Ld. DCDFR, Rampur, it transpires that the respondent/ complainant Sri Ram Prakash had purchased a Sofa-Set for Rs.13,000.00 from the Showroom of the appellant India Furniture House, Rampur. It has been alleged that the same Sofa-Set was of a low quality and, therefore, alleging deficiency in service, the respondent/complainant

filed complaint case no.114 of 2000 before the Ld. Forum for redressal of his grievances. The Forum below, after hearing the parties observed that the Sofa-Set was indeed of low quality and was not as per the specifications and, therefore, it ordered that the same be taken back and the price of the same be returned to the complainant with interest. The judgment and order is    based on facts, circumstances and evidence on record. There is no irregularity or illegality in the order and, therefore, we are not inclined to interfere in it. Consequently, the appeal, being meritless, is liable to be dismissed.

ORDER

The appeal, being meritless, is dismissed. No order as to costs. Certified copy of the judgment be provided to the parties in accordance with rules.
