Order dated 15.04.10 passed by the U.P. State Consumer Disputes Redressal Commission, Lukcnow (in short, ‘the State Commission’) in execution case no. 3/10, is sought to be assailed in the present appeal. Mr. Kulshreshtha, learned counsel for the appellant, Agra Development Authority submits that the appellant is willing to honour its settlement and to hand over the possession of the plot in question to M/s. Pratik Builders and Developers from whom, the sale ..2.. consideration was received but there seems to be some dispute among its partners, namely, R.P. Sharma, R.K. Singh and S.H. Rawat and, therefore, it is not able to ascertain to whom the possession of the plot should be handed over. It appears that this submission was not made before the State Commission when the impugned order came to be passed. We permit the appellant, Agra Development Authority to raise this submission before the State Commission and the State Commission will consider the same in accordance with law. With these observations, the first appeal stands disposed of. The parties shall appear before the State Commission on the date already fixed in the matter. Dasti.
