          This appeal is listed for March 11^th, 2016 but the file has been taken up today on the application filed by Birla Sun Life Insurance Company Limited-opposite party (appellant).

2.      Anil Kumar, nephew of complainant duly identified by Sh. Deepak Jain, Advocate has received the amount in question from learned counsel for the appellant through demand drafts (photocopies Annexure A-1 to A-4) in full and final settlement of claim.

3.      Learned counsel for the appellant has urged that since the entire payment has been made to the complainant, this appeal be dismissed as withdrawn.

4.      It is ordered accordingly.

5.      The statutory amount of Rs.2500/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
