O R D E R

 

NAWAB SINGH J, (ORAL):

 

          A complaint titled ‘Ram Phal Versus SDO OP Sub Urban Sub Divn. UHBVN Ltd., Gohana, Distt. Sonepat’ was decided by District Consumer Disputes Redressal Forum, Sonepat (for short ‘District Forum’) vide order dated March 10^th, 2016.

2.      Aggrieved of the said order, Sub Divisional Officer, Sub Urban, Sub Division, Uttar Haryana Bijli Vitran Nigam, Gohana, District Sonepat-opposite party filed appeal before this Commission, which was dismissed by order dated August 12^th, 2016, it was directed that statutory amount of Rs.25,000/- deposited by Sub Divisional Officer, Sub Urban, Sub Division, Uttar Haryana Bijli Vitran Nigam, Gohana, District Sonepat (for short ‘UHBVN’) be refunded to the complainant.

3.      By filing the present application, UHBVN seeks refund of the amount of Rs.25,000/- deposited at the time of filing of the appeal in its favour.

4.      Learned counsel for the applicant has stated that vide order dated 28^th September, 2016 (Annexure-I), UHBVN had made the payment of Rs.70,000/- vide cheque No.983837 dated 27^th September, 2016 (Annexure-II) to Ram Phal-complainant in execution application and the execution application was dismissed as withdrawn being fully satisfied.

5.      This being so, the amount of Rs.25,000/- deposited be refunded to applicant against proper receipt and identification in accordance with rules.

2.      Appeal No.302 of 2016 titled ‘Sub Divisional Officer, Sub Urban, Sub Division, Uttar Haryana Bijli Vitran Nigam, Gohana, District Sonepat Versus Ram Phal’ was decided by this Commission on August 12^th, 2016, it was directed that statutory amount of Rs.25,000/- deposited by Sub Divisional Officer, Sub Urban, Sub Division, Uttar Haryana Bijli Vitran Nigam, Gohana, District Sonepat (for short ‘UHBVN’) be refunded to the complainant. UHBVNL was directed by the District Consumer Disputes Redressal Forum, Sonepat (for short ‘District Forum’) to pay Rs.70,000/- to Ram Phal-complainant.

2.      Learned counsel for the UHBVN has placed on record copy of the order dated 28^th September, 2016, whereby amount of Rs.70,000/- was paid to Ram Phal-complainant vide cheque No.983837 dated 27.09.2016.

3.      By filing the present application, UHBVN seeks refund of the amount of Rs.25,000/- deposited at the time of filing of the appeal in its favour.

4.      This being so, the amount of Rs.25,000/- deposited be refunded to applicant against proper receipt and identification in accordance with rules.
