1.      Arguments heard.

2.      Learned counsel for the petitioner submits that there was friction between the petitioner and his previous counsel, therefore, she could not appear and in the interest of justice, the matter should be restored.  Learned counsel for the petitioner submits that he is new counsel and he will take care of this case.

3.      On the other hand, learned counsel for the respondent who appears in person, submits that the conduct of the petitioner has harassed him and application should not be accepted.

4.      In the interest of justice, we restore both the appeals before the State Commission subject to payment of costs of Rs.5000/- each to the respondent, which may be paid to him through demand draft in his favour directly before the State Commission.  The parties are directed to appear before the State Commission on 7.10.2013.  The State Commission will see that the costs have been paid and thereafter it will proceed to decide the case on merits.

A copy of this order be given dasti to learned counsel for the petitioner.
