1.      Learned counsel for the petitioner present.  None is present for the respondent.  Learned counsel for the respondent has submitted his message through email, which is as under:

Thanks for advance communication but I am now unable to attend the Hon’ble Court due to cancellation of railway reservation.  However, case can be disposed off in my absence & respondent in the light of letter dated 19/9/2013 filed by you with Hon’ble Commission which is acceptable to respondent as also admitted in the reply 22/3/2014 filed by the respondent.

As such prayer is also made to Hon’ble Commission that I have no objection if letter dt. 19/9/2013 of the petitioner is accepted & order may kindly be passed.

2.      This Commission in the similar case i.e. Punjab Urban Planning & Development Authority & Anr. Vs. Mr. Vijay Kumar, revision petition

No. 1672 of 2009, passed the order dated 13.10.2014.  Relevant portion of which runs as under :

“Mrs. Issar states under instructions that (i) the petitioner authority is ready to hand over possession of EWS tenements to the respondents on payment of double the original amount as was done in other cases (noticed in the order dated 26th July, 2011) and (ii) for this purpose, the respondents/complainants may approach the Estate Officer concerned and submit an appropriate application with regard to the terms of payment and time frame of handing over possession of the tenements in question.”

3.      In view of this submission, we accept the revision petition on the terms and conditions stated above.  The complainant in this case is directed to appear before the Estate Officer, Greater Ludhiana Area

Development Authority, Ferozepur Road, Ludhiana, (GLADA), (previously known as Punjab Urban Planning and Development Authority, Ludhiana,  on 1.2.2015 at 10.30 to 11.00 am and submit his

application regarding allotment and possession of tenement as well as terms of payment.  The Estate Officer shall take appropriate action expeditiously on the request made in the application of the respondent/complainant.

4.       In view of the above terms, the revision petition stands disposed of.     

5.       A copy of this order be sent to both the respondent/complainant and Mr. M. S. Sethi, Advocate through email.  Email address of Mr. M. S. Seth is available on the letter dated 7.10.2014.
