FINAL ORDER

The instant complaint has been filed by the complainant u/s 12 of the C. P. Act, 1986 praying for replacing the Battery Rickshaw and directed to pay a sum of Rs.20,000/- for harassment cost and Rs.20,000/- for mental pain and agony and also directed to pay a sum of Rs.34,000/- for loss of business.  

The complainant’s case is for replacement of defective Battery Rickshaw and non-issue of money receipts against Rs.26, 000/- .

The matter has been settled between the parties on compromise as per terms of Compromise Petition for payment of Rs.17,000/- towards the complainant by the complainant by two installments out of which the first installment is to be paid by 04.04.2016 for Rs.10,000/- and the Second installment is to be paid by 02.05.2016 for Rs.7,000/-.                

We find that the matter has been settled voluntarily between the parties            as per Solenama. As such the case be disposed of on consent with full satisfaction to payment of Rs.17, 000/- to the complainant by the OP in terms of compromise by two installments. The first installment for Rs.10, 000/- is to be paid by 04.04.2016 and the second installment for Rs.7000/- is to be paid by 02.05.2016 before this Forum.

 

Hence,

                                                      Ordered

that the Consumer Complaint No. 131/2014 be and the same is hereby allowed on compromise between the parties .  Solenama dt. 24.02.2016 do made a part of the order. The OP is to pay Rs.17,000/- to the complainant by two installments . The first installment for Rs.10, 000/- is to be paid by 04.04.2016 and the second installment for Rs.7, 000/- by 02.05.2016 before the Forum in terms of Solenama.

 

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
