As nobody is appearing on behalf of respondent no. 2, he is proceeded ex parte. Heard. Learned counsel for the petitioner has handed over original Matriculation Certificate issued by petitioner Board to respondent no.1, who is present in person today. It is contended by learned counsel for the petitioner that in view of the decision of Honle Supreme Court in Bihar School Examination Board Vs. Suresh Prasad SinhaCivil Appeal No. 3911 of 2003, decided on 4.9.2012, respondent no. 1 is not a consumer and as such consumer complaint is not maintainable. Learned counsel for respondent no.1 states that since petitioner has handed over original Matriculation Certificate to respondent no.1, respondent no.1/complainant does not press his complaint qua the petitioner. However, respondent no.1 reserve its right to seek appropriate remedy available to him qua respondent no. 2. Since petitioner has handed over original Matriculation Certificate to respondent no.1, the present revision petition has become infractuous and same stand disposed of as such. Liberty as sought for by respondent no. 1 against respondent no. 2 is granted, if available under the law. Dasti to both parties.
