None is responding on behalf of the appellant as well as respondent No. 1 insptie of several calls.

Learned counsel Sh. S.K. Gupta for respondent No. 2 and Sh. Chitradeep Rana, associate of Sh. Yogesh Sethi, learned counsel for respondent No. 3 have appeared.

A perusal of the order sheet reveals that the appellant is not responding from a long time before the Commission for placing his arguments after several calls.

We have also perused the impugned judgment dated 13.12.2012 which reveals that the complainant neither appeared before the District Commission, nor placed his own evidence in support of the complaint.

The impugned judgment also depicts that on account of absence of the complainant’s evidence, the consumer complaint was dismissed on merit after hearing the arguments placed by the opposite parties. 

All the facts transpire that the appellant, who was the complainant in the District Commission, is not interested to contest his own case, hence in the absence of the appellant, the appeal shall stand as dismissed.  Both the party shall bear their own costs. 

                       Copy of the order be forwarded with the original record, if any, to the concerned District Commission after expiry of the   statutory period.
