            Today the case is fixed for arguments.At this stage the Ld. counsel for the complainant on the instructions of the complainant, by making a separate statement,stated that he does not want to pursue with the present complaint due to some technical reasons; hence, he withdraws the same, with liberty to file  it afresh.

                        Heard. The learned counsel for the complainant has withdrawn the complaint with the liberty to file it afresh.  The prayer made by the  learned counsel for the complainant to file the  complaint afresh is declined on the ground that the complainant had concealed certain relevant facts in the complaint at the time of its filing and further, in the affidavit  Annexure C-A wherein it was not disclosed that the Insurance  Company i.e. ICICI Lambo. Gen. Insurance Company had settled the matter vide claim No.5983684 on 24.01.2017 by making payment of sum of Rs.52,273/- through cheque No.126197 dated 24.01.2017; hence the present complaint is hereby ordered to be dismissed as withdrawn.

                        A copy of this order be sent to the parties, free of costs and file be consigned to the record room, after due compliance.
