Heard Counsel for the Petitioner. There are concurrent findings of two fora that for mere breaking of seal is not sufficient to prove theft. In an earlier case of Uttari Haryana Bijli Vitran Nigam Ltd. V/s. Sohan Lal R.P. No. 3365/2007, this Commission had taken the view that evidence to prove theft was not sufficient and SLP was filed by the Petitioner before the Hon’ble Apex Court and we are informed by the Petitioner that the SLP has been dismissed. In the facts and circumstances of the case, we do not find that any case has been made out by the Petitioner for exercise of revisional jurisdiction under Section 21(b) of Consumer Projection Act, 1986 as we do not find any jurisdictional error, illegality or material irregularity in the order of the fora below. The revision is accordingly dismissed with no order as to costs.
