Sh. Shardul Negi, Advocate is present on behalf of respondent No. 1 – Sh. Rakesh Chandra Dimri, who is also present in person before this Commission.

None is present on behalf of respondent No. 2.

During the pendency of the present appeal, the parties have arrived at a compromise and in lieu of old mobile handset in question, new iBall Wings 4GP Tablet has been handed over by the appellants to the respondent  No. 1 – Sh. Rakesh Chandra Dimri.  Sh. Rakesh Chandra Dimri has also returned / handed over the old mobile handset to the appellants.

The appellants are directed to issue invoice and other allied papers regarding sale of new iBall Wings 4GP Tablet including warranty in favour of respondent No. 1 – Sh. Rakesh Chandra Dimri, within a period of one week.

In view of the above compromise arrived between the parties in full satisfaction of the claim of respondent    No. 1, the appeal is allowed.  Impugned order dated 28.05.2015 passed by the District Forum, Dehradun is set aside.  The statutory amount of Rs. 10,050/- deposited by the appellants at the time of filing the appeal, be released in their favour.
