2.       Samsung Customer Service, SCO No. 62, 1st Floor, Swastik Vihar, MDC Sector-5, Panchkula (Through its Authorized Signatory)

3.       Samsung India Electronics Pvt. Ltd. having its registered office at A-25, Ground Floor, Front Tower, Mohan Co-operative, Industrial Estate, New Delhi-110044 (Through its Managing Director)

COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 AS AMENDED UPTO DATE

Present:-      Shri Rajesh Bura, Advocate along with Complainant.

                   OPs No.1 and 2 already ex-parte vide order dated 22.11.2021.

                   Shri Balbir Singh, Advocate, Counsel for OP No. 3.

 

                   File taken up on an application moved by the Complainant seeking permission to withdraw the present case.                   

                   Ld. Counsel on the instructions of OP No. 3, by making a separate statement, stated that the OP No. 3 is ready to give a Cheque amounting to Rs. 50,000/- to the Complainant, within 40 days from today, in lieu of full and final settlement, subject to the return of the mobile set along with accessories by the Complainant with the OP No. 3.              

                   On the other hand, the Complainant, by making a separate statement, states that she has gone through the statement made by the Ld. Counsel for the OP No. 3 and agrees with the same and thus, she withdraws the present complaint, being fully satisfied.

         

                    Heard. In view of the statements made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective statements. In case, the OP No. 3 fails to comply with the statement made by the Ld. Counsel on its behalf, in that event, the Complainant shall be entitled to initiate proceedings under section 71/72 of the CP Act, 2019.            

                   A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
