The complainant Smt. Odiyanda Rathi Meenakshi filed this complaint against the opponent to direct him to pay Rs.1,41,000/-  for deficiency of service not continuing the construction of her residential house.

          After the service of notice the opponent has appeared in person and filed version.  There after the complaint was posted to file the affidavit evidence of complainant. Mean time on 15/09/2018 the complainant filed a memo permitting her to withdraw the complaint with a permission to file a fresh complaint containing detailed facts.

     On perusal of the complaint and version there was agreement between the complainant and opponent on 07/02/2017 to construct the residential house of complainant.  There after due to conflict between the parties the construction work was stopped.  The complainant is at liberty to withdraw her case and file a fresh complaint within the period of limitation.  Accordingly, we proceed to pass the following;

O R D E R

     The complaint filed by Smt. Odiyanda Rathi Meenakshi  w/o. Odiyanda Somanna is dismissed as withdrawn.  The complainant is at liberty to file a fresh complaint if she desires within the period of limitation.

     No order as to costs.
