BY THE STATE COMMISSION ( PER HON'BLE MRS. JUSTICE NISHA GUPTA,PRESIDENT):

 

This complaint has been filed with the contention that the complainant company paid Rs.11,01,650/- on 74.2014 for enhancement of load with non-applicant no.2 but inspite of the

payment the non-applicant has not provided three phase connection to the complainant. Hence, claim has been filed.

 

Heard the counsel for the complainant for admission of the complaint and perused the documents submitted alongwith the complaint.

 

At the out set the counsel for the complainant has accepted that connection is in the name of complainant company and it is industrial connection and when connection has been issued for commercial purpose the complainant could not fall under the definition of consumer and for industrial connection this Commission lacks jurisdiction.

 

Hence, in view of the above the complaint is not worth admission in lieu of lack of jurisdiction and dismissed.
