1) Heard both sides.
2) We observe from the record that C.C No. 260/2012 is still pending before the Dist. Forum and the revision petitioner/Opposite party has been set-exparte and IA No. 188/2012 has been filed by the opposite party to set-aside the ex-parte order.
3) As the Dist. Forum does not have jurisdiction it has rightly dismissed the petition vide Rajeev Hitendra Pathak Vs. Achyut Kashinath Karekar reported in CDJ 2011 SC 792. Taking into consideration that it is a CC of 2012 and also keeping in view the principles of natural justice, we are of the considered view that the opposite party may be given an opportunity to
appear and present the written version, however, due to latches on payment of costs of Rs. 1,000/- to be paid to the respondent/complainant. Both sides are directed to appear before the Dist. Forum without insisting on fresh notice on 29.4.2013 on which date, the opposite party shall file the written version and the Dist. Forum shall dispose of the case within three months as it is a matter pertaining to the year 2012. With the aforementioned directions this revision is allowed.
