O R D E R

RAM SINGH CHAUDHARY, JUDICIAL MEMBER:

 

1.                Mr. Ram Pal Verma, Advocate, learned counsel for the respondents has made a statement that he may be permitted to withdraw the complaint bearing No.503 of 2017, titled as “Rajni & Rajni and Anr. Vs. UHBVNL and Anr.” filed before learned District Forum, Sonepat with liberty to file afresh before Appropriate Authority.

2.                In pursuance of respective statement made by the learned counsel for the respondents, impugned dated 14.05.2018 passed by learned District Forum, Sonepat is set-aside and complaint No.503 of 2017 is dismissed as withdrawn with liberty to file fresh before Appropriate Authority. However, in terms of judgment of the Hon’ble Supreme Court in Laxmi Engineering Works Versus PSG Industries Institute (1995) 3 SCC 583, the respondents-complaiants may seek exemption/condonation of the time spent before the State Commission and District Fora.

3.                Statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the appellants against proper receipt and identification in accordance with rules.
